General terms and conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
• Cooling-off period: The period within which the consumer can exercise their right of withdrawal.
• Consumer: The natural person who does not act for purposes related to their trade, business, craft or profession and enters into a distance contract with the entrepreneur.
• Day: Calendar day.
• Long-term transaction: A distance contract concerning a series of products and/or services, for which the obligation of delivery and/or purchase is spread over time.
• Durable medium: Any tool that enables the consumer or entrepreneur to store information addressed to them personally, in a way that allows future consultation and unchanged reproduction of the stored information.
• Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
• Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.
• Distance contract: A contract concluded within the framework of a system organized by the entrepreneur for distance selling of products and/or services, where up to and including the conclusion of the contract, only one or more means of distance communication are used.
• Means of distance communication: A method that can be used to conclude a contract without the consumer and entrepreneur being in the same place at the same time.
• General Terms and Conditions: The current General Terms and Conditions of the entrepreneur.
Article 2 – Right of Withdrawal
The consumer has the right to withdraw from the contract within a 30-day cooling-off period without stating any reasons. During the cooling-off period, the consumer shall handle the product and its packaging with care.
If the consumer exercises their right of withdrawal, they shall return the product with all supplied accessories and if reasonably possible in its original condition, following reasonable instructions from the entrepreneur.
Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the consumer will be provided with the text of these general terms and conditions. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be viewed at the entrepreneur’s premises and will be sent free of charge upon request by the consumer.
If the distance contract is concluded electronically, the text of these general terms and conditions can, contrary to the previous paragraph, be provided to the consumer electronically in such a way that it can be stored by the consumer in a simple way on a durable medium.
If this is not reasonably possible, it will be indicated before the distance contract is concluded where the general terms and conditions can be viewed electronically and that they will be sent free of charge electronically or otherwise upon request.
If, in addition to these general terms and conditions, specific product or service conditions apply, the second and third paragraphs apply accordingly, and in the event of conflicting conditions, the consumer can always rely on the applicable provision most favorable to them.
If one or more provisions in these general terms and conditions are at any time wholly or partially void or nullified, the agreement and these terms and conditions will remain in force for the rest, and the relevant provision will be replaced in mutual consultation by a provision that approximates the original as much as possible.
Situations not regulated in these general terms and conditions must be assessed ‘in the spirit’ of these general terms and conditions.
Uncertainties about the interpretation or content of one or more provisions of our terms and conditions should be interpreted ‘in the spirit’ of these general terms and conditions.
